Meta Glasses Face Growing Privacy Scrutiny Across Europe

German officials have raised the prospect of restrictions, as regulators and lawmakers across Europe question whether Meta’s smart glasses give bystanders enough warning when they are being recorded

Meta’s camera-enabled smart glasses are facing growing privacy scrutiny across Europe, as officials, regulators and lawmakers examine whether the devices provide meaningful notice to people who may be filmed.

The debate has become particularly acute in Germany, where the commissioner of Hamburg’s data protection authority (DPA), Thomas Fuchs, has said an outright ban on smart glasses could be possible.

Fuchs told German broadcaster ARD that tests conducted by his office found the LED recording indicator on Meta’s glasses was too faint to be reliably seen in normal daylight.

He has also said he is discussing possible policy approaches with counterparts in Ireland, where Meta’s European headquarters are located, raising the prospect of an EU-level response.

Germany Raises The Prospect Of Restrictions

Germany is the clearest example so far of an authority openly discussing restrictions on smart glasses.

The country has a strong culture of privacy protection, and photographing or filming people without their consent can be unlawful.

But with smart glasses, victims may struggle to establish that a recording took place, identify the person who made it, or demonstrate that the footage was then used or shared.

A smartphone generally creates an obvious social signal. A person raises it, points it and holds it in position. Smart glasses remove much of that visual warning, making recording possible through a device that resembles ordinary eyewear.

Speaking to UC Today, Jakub Zientala, founder of EU public affairs consultancy Ungovern, said regulators should begin by asking whether the product itself delivers adequate notice.

β€œSmart glasses remove that gesture. They look like ordinary eyewear,” he said.

β€œA person can record while standing in front of you, and nothing in the situation makes that clear.”

He said technical safeguards should be made more robust before policymakers reach for a blanket prohibition. That could include a brighter, more conspicuous recording light that is visible outdoors and difficult to block or disable.

Devices could also be designed to stop recording if the warning light is covered, damaged or stops functioning, he said. In more sensitive settings, such as hospitals or changing areas, an audible notification could also be justified.

β€œThe less visible the camera becomes, the more visible the warning must be,” he added.

Privacy Watchdogs Are Expanding Their Focus

The German debate sits within a broader European pattern of regulatory concern, although there is no announced EU-wide proposals to ban Meta’s glasses.

In France, privacy regulator CNIL warned in May that smart glasses could present a significant risk of normalising omnipresent surveillance.

The warning reflects a core concern among privacy advocates: technology that captures images discreetly may erode people’s ability to understand, object to or avoid data collection in everyday settings.

Ireland has also played a central role. The Irish Data Protection Commission, which oversees Meta’s compliance with EU privacy rules because of the company’s European base in the country, has previously questioned whether the glasses’ indicator gives bystanders sufficient warning that recording is underway.

That engagement contributed to changes including a larger, blinking recording light and tamper-detection measures designed to make it more difficult to obscure the indicator.

The Irish regulator has more recently sought information from Meta after reports that sensitive footage captured by users of its AI-enabled glasses could be viewed by contractors in Kenya.

Meta has said shared content is filtered to protect privacy, including through measures such as face blurring, and that captured media remains on a user’s device unless they choose to share it with Meta or others.

In the UK, the Information Commissioner’s Office wrote to Meta in March following reporting on the handling of sensitive smart-glasses footage. The regulator said products processing personal data should put users in control and provide appropriate transparency.

Design Standards Before A Ban?

Zientala argued that a ban should be a last resort, rather than the first answer to new technology that creates a privacy risk.

β€œA ban should be the last option,” he said. β€œIt should not be the first response to every new technology that creates a risk.”

Instead, he said authorities should use existing data-protection powers more effectively, set clear and enforceable product-design standards, and impose targeted restrictions in high-risk environments.

Hospitals, schools, changing rooms and some workplaces could require specific rules, he said. That approach would focus on situations where people have particularly strong expectations of privacy, or where power imbalances make meaningful consent harder to establish.

But as cameras become less visible, pressure is likely to grow for regulators to define what meaningful notice looks like in practice – and whether a small LED light is enough to protect the people on the other side of the lens.
